Eminent Domain bill in the Legislature

The 2005 Supreme Court decision (Kelo vs. City of New London) means that private land can be taken through the eminent domain process and given to another private party for economic development or private business if that business is deemed appropriate by public officials.

Two bills are in the MS Legislature that deal with eminent domain - the taking of private land for public use. Both of these bills, one in the House and one in the Senate, bar the taking of private property for economic development projects. These two bills will be sent to a conference committee to resolve their small differences. Mississippi Farm Bureau supports the passage of a law restricting the taking of private property through the eminent domain process to only projects for public use such as highways, utilities, and railways.

Many states around the country have strengthened their eminemt domain laws to prevent the taking of private land for corporate business use.

Waide believes that eminent domain proceedings do not need to be used in most cases. Willing buyers and willing sellers will provide plenty of land for private economic development.

Waide urges private landowners to contact their elected representatives and urge them to pass legislation that resricts eminent domain to its original purpose.
